Who can use the service

You must be at least 18 years old and able to enter a contract. If you use the service for an employer or client, you confirm you may accept these terms for them, and "you" then means that organisation.

Your account

You sign in with a link sent to your email address. Anyone who can read that inbox can reach your account, so keep it secure. Tell us at support@rokon.tech if you believe someone else has used your account. You are responsible for activity under your account.

Credits

One credit produces one video. Each link you submit produces two videos and uses two credits. New accounts receive two free credits, enough for one link. Further credits are bought in any quantity from 4 to 1000, at the price shown at the time of purchase.

Credits are a prepaid licence to use the service. They are not money, not a stored value account, and carry no cash value. They cannot be transferred, sold or exchanged, and they are not redeemable for cash except where the law requires it. Credits do not expire while your account is open and in good standing. Refunds are covered by our refund policy.

If a video fails to generate, its credit returns to your balance automatically, and each of the two videos is counted separately. A completed video consumes its credit even if you dislike the result, because the cost of generating it has already been incurred.

The links you submit

You may only submit a web address that you own or are authorised to promote. You are responsible for making sure that producing and publishing a video about that page does not infringe anyone's copyright, trademark, privacy or other rights.

We read the public content of the page you submit in order to write the video. We do not attempt to bypass logins, paywalls or access controls, and you must not use the service to do so.

Videos the service produces

Between you and us, the video belongs to you, and we claim no ownership of it. We assign to you whatever rights in the output we are able to assign, subject to the terms of the model providers we rely on.

Videos are machine generated. Similar prompts can produce similar results for other customers, so your video is not exclusive and may not be original. Output can be inaccurate, unexpected or unsuitable. Review every video before you publish it, and do not present it as a factual record. You are solely responsible for what you publish.

We may keep a copy of the pages you submit, the prompts written and the videos produced, in order to run and improve the service, as described in our privacy policy.

What you must not do

You must not use the service to create or distribute material that:

• breaks the law, or infringes anyone's intellectual property, privacy or publicity rights;
• impersonates a person, business or public body, or misleads people about who is behind it;
• is sexual, hateful, harassing, violent, or depicts a real person without their permission;
• promotes fraud, scams, malware, or dangerous or regulated products in breach of the rules that apply to them;
• concerns elections, public health or other sensitive subjects in a deceptive way.

You must also not resell or redistribute the service itself, probe or overload our systems, work around usage limits or the credit system, or open extra accounts to collect additional free credits. We may suspend or close accounts that do, and forfeit credits obtained that way.

Services we rely on

The service runs on Google Firebase, generates video and text through Fal.ai and the model providers reachable there, delivers email through Resend, and takes payment through Stripe. Their availability and their own terms affect what we can deliver.

Availability and changes

The service is provided as it is, without any service level commitment. We may change, suspend or discontinue any part of it, including prices and the amount of the free allowance, at any time. Where a change is significant and you hold unused paid credits, we will give reasonable notice by email.

Payment

Stripe processes payments and we never receive your full card details. Prices exclude taxes unless stated, and you are responsible for any tax that applies to you. If a payment is reversed or charged back, we may suspend your account and remove the credits it paid for.

Ending the agreement

You may stop using the service at any time and ask us to delete your account. We may suspend or close an account that breaches these terms, or where required by law. When an account closes, unused credits are forfeited unless the refund policy says otherwise.

No warranty

THE SERVICE AND EVERYTHING IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not promise that the service will be uninterrupted or error free, that a video will meet your expectations, or that a video will be suitable for any particular campaign, platform or audience.

Limit of our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, ROKONTECH LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, NOR FOR LOST PROFITS, LOST REVENUE, LOST DATA OR REPUTATIONAL HARM, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS.

Nothing here excludes liability that cannot be excluded by law.

Covering our losses

You agree to defend and indemnify ROKONTECH LLC, and its owners and staff, against claims, damages and reasonable legal costs arising from your use of the service, the links you submit, the videos you publish, or your breach of these terms.

Governing law

These terms are governed by the laws of the State of [STATE], United States, without regard to conflict of law rules. The courts located in [COUNTY, STATE] have exclusive jurisdiction, and each side waives any objection to that venue.

Other terms

If any clause is unenforceable, the rest continues to apply. Our failure to enforce a clause is not a waiver of it. You may not transfer this agreement without our consent; we may transfer it as part of a merger or sale of the business. These terms, with the privacy and refund policies, are the entire agreement between us.

We may update these terms. Material changes will be announced by email or in the app before they take effect, and continuing to use the service after that means you accept them.
